Overview
Welcome to TRADEPLUS AU (ABN 87 687 663 529). In these terms, "we", "us" and "our" mean TRADEPLUS AU. We run this store and website, including all related information, content, features, tools, products and services (the "Services"). Our store is powered by Shopify.

These Terms of Service ("Terms"), together with the policies they refer to, set out your rights and responsibilities when you use the Services. By visiting, using or buying through the Services, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the Services.

Your rights under the Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any right, remedy or guarantee you have under the Australian Consumer Law or any other law that cannot lawfully be excluded or limited.

1. Access and accounts
By agreeing to these Terms, you confirm that you are at least 18 years old. To use the Services, you may need to give us information such as your email address and your billing, payment and delivery details. You confirm that the information you give us is correct, current and complete.

You are responsible for keeping your account login details secure and for all activity on your account. You can't transfer, sell or assign your account to anyone else.

2. Our products
We work to describe and show our products accurately. Product images are for illustration, and colours and finishes can look slightly different on screen depending on your device and settings, so if a finish matters for your job, contact us before you order. All products are subject to availability, and we may update product descriptions, discontinue products or limit quantities at any time.

3. Orders
When you place an order, you are making an offer to buy. We may accept or decline an order for any reason, including suspected fraud, payment issues or stock availability. An order is only accepted once your payment has been processed and we've sent you an order confirmation email. Please check your order carefully before submitting it, as we may not be able to cancel it once it has been accepted. If we decline, change or cancel your order, we'll try to let you know using the email address, phone number or address you gave us.

You can buy from us for personal, household or business use, including for installation in projects you carry out for your clients. If you buy goods for business use, some consumer guarantees may not apply where the goods aren't of a kind ordinarily bought for personal, domestic or household use.

Returns and exchanges are covered by our Refund Policy and your rights under the Australian Consumer Law.

4. Prices and payment
All prices are in Australian dollars and include GST. Shipping costs, where they apply, are shown at checkout. Trade pricing is available on request: contact us.

Prices, discounts and promotions can change without notice. The price you pay is the price shown when you place your order, as set out in your order confirmation email. Promotions may have their own terms, and if those terms conflict with these Terms, the promotion terms apply.

You agree to give us current, complete and accurate purchase and payment information, and you confirm that you are authorised to use the payment method you choose.

5. Shipping and delivery
We deliver Australia-wide. Delivery times are estimates only. We're not responsible for delays caused by carriers, weather, incorrect delivery details or other events outside our control, but we'll keep you updated if your order is delayed. Please make sure your delivery address is correct, as additional delivery charges may apply if re-delivery is needed.

6. Click & collect
You can collect your order free from our Campbellfield warehouse. We'll let you know when it's ready. Please bring your order confirmation and valid ID when you collect. We're not responsible for delays if an order isn't collected within the timeframe we give you.

7. Risk and ownership
Risk of loss or damage passes to you when the goods are delivered to your nominated address or collected. Ownership of the goods passes to you once we've received full payment.

8. Installation and product use
You're responsible for making sure the products you buy suit your intended use and are installed and used correctly, in line with Australian Standards, building regulations and the manufacturer's instructions. To the extent permitted by law, we're not liable for damage or injury caused by incorrect installation, misuse or not following product instructions.

9. Intellectual property
The Services, including all trademarks, brands, text, images, graphics, product reviews, video and audio, and their design, selection and arrangement, are owned by TRADEPLUS AU, our affiliates or our licensors, and are protected by Australian and international intellectual property laws.

You may use the Services to browse and buy our products, including for your business. You must not copy, reproduce, distribute, modify, republish, download or transmit material from the Services for any other purpose without our written consent. Nothing in these Terms gives you a licence to use any intellectual property of TRADEPLUS AU, Shopify or any third party.

TRADEPLUS AU's name, logos, product and service names, designs and slogans are trademarks of TRADEPLUS AU or our affiliates or licensors, and you must not use them without our written permission. Shopify's name, logo and related marks are trademarks of Shopify. All other names and marks on the Services belong to their respective owners.

10. Optional tools
We may give you access to third-party tools as part of the Services, which we don't monitor or control. To the extent permitted by law, these tools are provided "as is" and "as available", and your use of them is at your own risk. Please make sure you're comfortable with the terms on which the relevant third party provides them. Any new features or tools we add to the Services are also covered by these Terms.

11. Third-party links
The Services may link to websites or content run by third parties. We're not responsible for checking or evaluating that content, and if you choose to visit those sites, you do so at your own risk. Please review the third party's policies before you transact with them, and direct any questions about their products or services to them.

12. Relationship with Shopify
TRADEPLUS AU is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with TRADEPLUS AU. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and TRADEPLUS AU, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with TRADEPLUS AU.

13. Privacy
We handle personal information in line with the Privacy Act 1988 (Cth) and our Privacy Policy. Some personal information may also be subject to Shopify's Privacy Policy. Because the Services are hosted by Shopify, information you submit is shared with Shopify and third parties that may be located outside Australia, so that they can provide the Services to you.

14. Feedback and reviews
If you send us ideas, suggestions, feedback, reviews or other content ("Feedback"), you give us a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish and display that Feedback for any purpose, including to promote the Services. You confirm that you own or have the right to share your Feedback, that you've disclosed any payment or incentive you received for it, and that it doesn't break the law or anyone's rights. We may, but don't have to, monitor, edit or remove Feedback that we consider unlawful, offensive or in breach of these Terms. We're not required to keep Feedback confidential, pay for it or respond to it.

15. Errors and omissions
Occasionally the Services may contain errors, inaccuracies or omissions, including in product descriptions, pricing, promotions, shipping charges, delivery times and availability. We may correct these at any time, and may update information or cancel orders if information is inaccurate, including after you've placed your order. If we cancel an order you've paid for, we'll refund you in full.

16. Prohibited uses
You may only use the Services for lawful purposes. You must not use the Services to: break any law; infringe our intellectual property or anyone else's; harass, abuse, defame or harm our team or anyone else; send false or misleading information; send spam or unsolicited promotional material; impersonate any person or business; upload viruses or malicious code; collect other people's personal information; scrape or crawl the Services; or interfere with the security or operation of the Services. We may suspend or close your account if you break these Terms.

17. Termination
We may end these Terms or your access to the Services at any time. You remain responsible for any amounts owed up to that date. Sections that by their nature should continue, including intellectual property, feedback, disclaimers, limitation of liability, indemnity and governing law, continue after termination.

18. Disclaimer
Information on the Services is provided for general information only. Subject to your rights under the Australian Consumer Law, and to the extent permitted by law, the Services are provided "as is" and "as available", and we don't guarantee that the Services will be uninterrupted, timely, secure or error-free.

19. Limitation of liability
Subject to your rights under the Australian Consumer Law, and to the extent permitted by law, TRADEPLUS AU, our directors, employees, affiliates, agents, contractors and suppliers, and Shopify and its affiliates, are not liable for any indirect, incidental, special or consequential loss or damage, including loss of profits, revenue, savings or data, arising from your use of the Services, delivery delays, incorrect product selection, or the installation or use of products.

20. Indemnity
To the extent permitted by law, you agree to indemnify TRADEPLUS AU, Shopify and our affiliates, partners, officers, employees, agents, contractors, licensors and service providers against any losses, damages, liabilities or claims, including reasonable legal costs, payable to a third party because of your breach of these Terms, your breach of any law or the rights of a third party, or your use of the Services.

21. Severability
If any part of these Terms is found to be unlawful, void or unenforceable, that part will be enforced to the fullest extent permitted by law and the rest of these Terms will continue to apply.

22. Waiver and entire agreement
If we don't enforce a right or provision of these Terms, that doesn't mean we've waived it. These Terms and the policies they refer to are the entire agreement between you and us about the Services, and replace any earlier versions of these Terms.

23. Assignment
You may not transfer or assign these Terms or your rights under them without our written consent. We may transfer or assign these Terms and our rights and obligations.

24. Governing law
These Terms are governed by the laws of Victoria, Australia. You and TRADEPLUS AU agree to the non-exclusive jurisdiction of the courts of Victoria.

25. Headings
Headings in these Terms are for convenience only and don't affect their meaning.

26. Changes to these Terms
You can view the current version of these Terms on this page at any time. We may update them by posting changes on our website, and we'll tell you about material changes as required by law. Changes take effect from the date they're posted, and continuing to use the Services after that means you accept the updated Terms.
